Terms of sale,
including the
parts that bind us.

§ L.2.1The short version
Nine terms that matter most.
| Term | What it means |
|---|---|
| Quote validity | Firm for 30 days on the quantities and conditions quoted |
| Grade conformity | Units conform to the published criteria for the stated grade |
| Mis-grade remedy | Replacement or credit, at your election, on notice within 14 days |
| Testing | 100% of reuse stock pressure tested with a hold phase; records available per unit |
| Title and risk | Pass on delivery for sales; on collection for purchases |
| Payment — purchases from us | Net 30 on approved account, otherwise prepayment |
| Payment — sales to us | On collection, or within 5 business days for graded elements |
| Residues | Seller declares accurately; undeclared residues are chargeable |
| Compatibility | Chemical compatibility with your product is your assessment |
These are summaries. The full terms follow and prevail where there is any difference.
§ L.2.2Full terms
In full.
1. Scope
These terms apply to all purchases of goods and services from IBC Pickup LLC, all sales of containers to us, all toll reconditioning, and all freight arranged by us, unless a separate written agreement signed by both parties states otherwise.
2. Quotes and orders
Quotes are firm for thirty days on the quantities, grades, specifications and site conditions quoted. Where what is presented differs materially from what was declared — a different count, undeclared part-full units, site conditions requiring different equipment — we re-quote rather than adjusting an invoice without notice.
An order is accepted when we confirm it in writing. A purchase order referencing conflicting terms does not vary these terms unless we accept the variation in writing.
3. Grades and conformity
Containers supplied as a stated grade conform to the criteria published on our grading scale page as at the date of the quote. Those criteria form part of these terms.
Where you specify attributes rather than a grade — for example a wash programme, a gasket compound, a test type or a restricted fill history — those attributes form part of the specification and we are bound by them.
4. Inspection and remedies
Please inspect on arrival. Notify us of any unit not conforming to its stated grade or specification within fourteen days of delivery, with photographs. We will replace or credit the unit at your election, including return freight where the non-conformity is ours.
We do not require you to return a non-conforming unit before we credit it. A mis-grade is our process failure.
5. Testing and documentation
All reuse stock is pressure and leak tested with a hold phase, on every unit, with no statistical sampling. Test records, wash programme codes and previous-contents chains are available per unit on request, and the load manifest carries the per-unit grade breakdown as standard.
6. Chemical compatibility and fitness for purpose
We supply container specifications, fill histories, test records and material data. The assessment of whether a container is compatible with your product — at your concentration, your temperature and your contact duration — is yours, because it requires product data we do not hold.
Where you tell us the product, concentration, temperature and contact time, we will recommend a specification. A recommendation is advice given in good faith and does not transfer the compatibility assessment to us.
7. Regulated transport
Recertification to a UN design type covers suitability for transport within that design type and packing group. It does not cover compatibility with your material, food-contact suitability, or pressure or vacuum service. The scope is set out on our certifications page.
8. Residues and declarations
Where you sell or send containers to us, you warrant that the previous-contents declaration is accurate and complete to the best of your knowledge, and that it does not include any material on our published exclusion list.
Undeclared residues discovered at intake are handled at your cost, quoted before any work is done. Materials on the exclusion list are quarantined and returned at your cost. We will always tell you before a truck is booked where a declaration raises a problem.
9. Freight, title and risk
For sales to you, title and risk pass on delivery to the address specified. For purchases from you, title and risk pass on collection, once counted on site.
Lead times are given in good faith and are not guaranteed. Where a delay is ours, we will tell you as early as we know and we will not substitute a lower grade without your agreement.
10. Toll reconditioning
Your containers remain your property throughout. Serials are recorded at collection and reported at return. Units that fail testing are dealt with by the option you selected at order — returned marked as failed, purchased by us at the applicable rate, or rebottled at quoted cost.
11. Payment
Purchases from us are Net 30 on an approved account, otherwise prepayment. Sales to us are paid on collection for agreed quantities, with any grade-dependent portion settled within five business days of grading, accompanied by the per-unit breakdown.
12. Limitation of liability
Our liability for any claim relating to goods or services supplied is limited to the invoiced value of the goods or services giving rise to the claim. We are not liable for indirect or consequential loss, including lost production, lost profit or the value of product lost from a container.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited.
13. Governing law
These terms are governed by the laws of the State of Illinois, and the courts of Cook County, Illinois have exclusive jurisdiction.

Our exclusion list
We do not accept containers whose declared previous contents include acutely toxic or P-listed materials, radiological or biohazardous residues, unstabilised reactive monomers, or polychlorinated biphenyls. Nor do we accept any unit with an undocumented fill history onto our food-grade path.
Full compliance scope →Supplier agreements
We read supplier quality agreements and approved-vendor questionnaires properly, and we flag clauses we cannot meet rather than signing and hoping. Send yours before you need stock rather than during an outage.
Questions before you order
If a term does not work for your procurement process, say so.
Most of these are negotiable in a written agreement. The grade criteria and the compatibility position are not.
